  • Account information. This may include your name, email address, and password. If you choose to log in through third parties, such as Gmail or Google account, we receive information about the service you used to log in and — depending on your account settings with the third parties — details about you, including your name, email address, or unique user identifiers.
  • Profile information. We may require you to provide a nickname for us to address you.
  • User Content: We may collect your User Content, including but not limited to facts you may provide about you or your life, and any photos, videos, and voice and text messages you provide or receive.
    • When you create a character through the Services, we may use audio, visual, and textual data you provide, including any personal information contained within your content. This information is used to create and maintain your character, allow others to find your character if you choose, and to train AI models to generate content, improve the Services, and support our business purposes.
    • When you interact or chat with a character, we may collect device and network data, User Content, and any personal information contained in the chats. This information is used to facilitate your chat experience, monitor chats for safety and compliance with our Community Guidelines, and train AI models for improving the Services and supporting our business purposes.
  • Device Permissions: To provide and enhance the Services, SpicyAI may request access to certain features or data on your device, including but not limited to your camera, microphone, photos, videos, and storage. These permissions are used solely to enable functionality within the Services, such as:
    • Audio and Video Input: Allowing you to record or send voice messages and videos to interact with AI characters or create custom avatars.
    • Photos and Media Access: Enabling you to upload images or videos to create characters, personalize your experience, or share content within the Services.
    • Storage Access: Storing files locally on your device for faster access, caching, or supporting application functionality.
    By granting these permissions, you allow the Services to collect, use, and process the relevant data for the purposes described above. You may choose to deny these permissions, but some features of the Services may not function properly or may be unavailable if permissions are not granted. We do not access or use your device data beyond what is necessary to provide these features and will handle any collected data in accordance with this Privacy Policy and applicable law.
  • Interests and preferences. You may select conversation preferences, such as topics you would like to discuss, and communication preferences, such as the times of day you like to use the Services. We also learn about your interests and your preferences over time through your use of the Services to personalize your conversations and the features of the Services.
  • Payments, transactions, and rewards. When you make purchases through the Services, our third-party payment processors, may collect your payment information. We maintain a record of your purchases, the features you select, and the rewards you earn and use.

  • Service Provision: Providing a personalized SpicyAI experience, allowing profile customization, personalized interests, and interactions. We use information collected during character creation and chats to create and maintain your characters, facilitate chat interactions, monitor for safety and appropriateness, and to train AI models for improving user experience and supporting our business purposes.
  • Services Monitoring and Protection: Safeguarding against fraud, criminal activities, and misuse, ensuring operation of IT system, architecture, and network security through testing, maintenance, support, and data hosting.
  • Trends Analysis: Aggregating, anonymizing personal data, analyzing Service use patterns, enhancing features based on usage trends.
  • Legal Compliance and Enforcement: Enforcing our agreements, complying with legal obligations, and defending against legal claims and disputes, enforcing and complying with our terms and policies, protect our and others' rights, privacy, safety, or property.

  • Service providers: We share your information with companies and individuals that provide services on our behalf or assist us in operating the Services or our business. 8. Use of SpicyAI by Minors

By accessing or using the Services, you represent and warrant that you are at least 18 years of age or meet the minimum age required in your jurisdiction to access online services. Users who do not meet the applicable minimum age are strictly prohibited from using the Services.

We may implement age verification measures to ensure compliance with these age requirements. If we become aware that a user under the applicable minimum age has accessed the Services, we will take immediate steps to block access, suspend or delete the account, and remove any personal information provided by the user to the extent reasonably possible.
